As for my rant...my English class is really heavy. This Thursday, I have to think of a major decision that I made in my life that has affected other people (and I really can't think of anything huge), then write three pages of work on it...in two hours. And our teacher is a hard 'grader'. and that's our easiest assignment that she discussed. It wouldn't be so hard if I actually could think of a major decision, but my life has been relatively boring up until now. No health problems, pregnancy scares...everyone has problems, but not much that I had to make a MAJOR decision that has affected other people a lot. *sigh*

Major life decisions you must have made:

1) Going to college
2) Having sex/not having sex before marriage
3) Getting drunk/not getting drunk at a party
4) Doing drugs/not doing drugs
5) Getting your driver's license (and that's recent)

Dunno if that helps, but those are fairly obvious teenage issues that all teenagers face.

Yeah, I was thinking about the going to college one, but they said one that you've lived with for a while...I guess I decided to a while back. I don't really count my driver's license as a major decision, tho it does kind of effect other people...again, my ability to drive (legally) is recent...the other ones are good too...hmm, I'll think about it. Thanks!

Bonus! Reading Comprehension Quiz

What the hell did I just write, while at the law library?

Quote:
The two-level test under the current copyright act (1978) seems facially understandable. The federal law can only trump the state law if they are “equivalent” and if the state right falls within the aegis of copyright. That makes sense. I am confused why literary titles don’t fall under copyright, though (and thus survive preemption), because it would seem to me that one of the most important parts of a work is, often, its title. Would To Kill a Mockingbird carry the same weight as a work if it were titled “My Dad’s Defense of an Innocent Man, by Scout, Age 6”? I am not sure what solution I would advance here, though. I would think that once the title becomes unique – ie, To Kill a Mockingbird, For Whom the Bell Tolls, As I Lay Dying, whatever – it should have some sort of protection, or else you run the risk of imitation or, worse, copying with the intent to deceive. As I read sections 10:34 and 10:35 of McCarthy’s work, there’s no ability to rectify this at present.

This is of particular concern when trademark dilution itself appears to have federal registration as a complete defense against state antidilution law. If trademarks can be registered so that they are not subsumed by another trademark of similar or virtually equivalent appearance, why can’t titles have the same thing? As a writer, this is troubling. I know how hard it is to come up with a good title, and it would be disappointing if someone just took mine with no remedy available to me.

Furthermore, in reading the DeCosta case at 10:46, it seems to me that the federal courts engage in a very deliberate, choosy policy of who can enjoy remedies under federal law and who cannot (wherein they stated that a non-profit cowboy character was preempted from receiving remedies he had been given by the state against CBS, owing to Sears-Compco overruling misappropriation doctrine). I suspect that preemption is used in a similar fashion today – some things are allowed to survive and some are not based merely on an arbitrary decision of what constitutes valid service marks and what does not. I would like to see firmer legislation on this front as well, so that it is clear what federal law addresses and what state law addresses. I suspect we’re a long way away from that, though.

We were supposed to read the articles on preemption in any one of 3 given treatises and write a one-page comment on it. I think I did that. I'm still not sure what I wrote, even re-reading it back at my apartment.

Hulk mad, Hulk smash.

My cable TV and internet at home went out a half hour ago.

After a half-hour idiotic telephone call with Comcast, it was determined that, yes, there was a problem (oh gee, really?!), and they would have people out there on Saturday. So I'm screwed until then regarding my appellate brief, unless I want to sit here at the law school and do it (which I will do, but I hate the stress of this place, and I hate people talking around me - though I have to have the TV on, contradictorily enough.)

F*ck you, Comcast.

ETA: Even better, the TV here is out as well, which means I can't drown out the first-year law students virtually screaming n the lounge, and I can't work in the library because, oh my God, stress. (I tense up every time I enter the library if I don't have to do book research, and wind up being majorly stressed out by everyone else's stress. If I were the only person in there amongst the books, I'd be fine, but I can't deal with other people losing their minds all around me.)

I might be making extensive use of this thread until current work is done.

And to think, moot court is only one credit per semester.

No stress, right?

-Much needed bump-

UGH, I AM SO ANGRY! TV today is a load of CRAP! MTV makes me want to VOMIT!!!!!!!!

As if it wasn't enough I had to see Shayne Ward's talentless mug on my TV (after having had NO SIGN of him since he won X Factor and released his single), I sat through his damn music video which was basically just him and this Underwear Woman climbing all over each other. I mean, SERIOUSLY?! Kids watch this crappy channel. No wonder there is so much bad in the world. Chavs, pregnant teenagers! They call that MUSIC?! I wouldn't buy that crappy song or video if you payed me!
Television is full of crap these days. Do you know how disgusting and pressurising it must be? If you've seen one, you've seen it all.

Just had to get that out of my system. Stupid Shayne Ward

I know what you mean!! I'm tired of television advertising sex and drugs to young kids all the time, mainly through tv shows and music. And now they sell all these skimpy cloths to little kids...it's just so weird. *shakes head* As if the world isn't crazy enough, you don't have to taint kids so much. I say this having a little bro and sis, as well as having worked at a daycare place for a few years.
