Just tonight my LOST videos on Youtube were taken down. I got a copyright infringment letter stating this:

This is to notify you that we have removed or disabled access to the following material as a result of a third-party notification by The Walt Disney Company claiming that this material is infringing:

Please Note: Repeat incidents of copyright infringement will result in the deletion of your account and all videos uploaded to that account. In order to avoid future strikes against your account, please delete any videos to which you do not own the rights, and refrain from uploading additional videos that infringe on the copyrights of others. For more information about YouTube's copyright policy, please read the Copyright Tips guide.

If you elect to send us a counter notice, to be effective it must be a written communication provided to our designated agent that includes substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

(A) A physical or electronic signature of the subscriber.

(B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

(C) A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

And how did Disney get involved? Oh crap, they own ABC, don't they??????????? That's seriously baaaaaaaad news!

You know, if we were charging people to watch our vids, or were selling them on DVDs or something like that, I can see where they'd have a right to be upset. But we're not making any profit from these vids at all and they in fact serve to promote both the shows and the music that are used. I wasn't very into Firefly until I saw some fan vids about it and they intrigued me enough that they're gonna end up getting money from me off the Serenity movie and the DVD set! I know I'm not alone in having bought CDs after hearing songs on vids that I probably wouldn't have heard any other way! These things are great fan-recommendations for the shows and music! What more do they want?

I KNOW I've never seen one vid where the vidder said, "I own this show and I own this song!"

Not that my rant is gonna matter, I know...

Anyway, sorry to hear that this happened to you, Mike!

Yes. Exactly what Aislynn said. Also, I bought the Season 1 DVD and I am planning to buy the 2nd Season one too. So I think it should be okay since I still spend money buying the dvd's. I also usually have "for entertainment purposes only" at the end of my videos and that is exactly what they're for!

Like Aislynn said, it's not like we're profiting of this or anything and I can't believe they're wasting their time taking down your vids. It's not like people think us vidders made Lost so I don't really get this "copy infringement" crud.

I hear ya there, I paid good money for Season 1 and will be getting season 2, and I even put Clips Courtesy of ABC's LOST Season 1 DVD at the beginning. I tell I was surpised when I saw the email.

Crap! What are we gonna do now? You tube is one of the best site's to upload to. I mean, what now? Should we start removing them or FIGHT THE POWER?

Colin, I remember you saying that and I feared that too. Sometimes keeping things on the downlow is a good idea when you are using someone else's property. That's why I never submitted CE to the search engines, I didn't want anyone getting in trouble.

So, was it just a normal Lost Music Video?

I don't see why they have a problem with it really, like everybody has already said, it's free publicity. I stopped watching Lost around the 'Walkabout' episode (in the UK), and only started watching it again after I saw a music video that contained, amongst others, some footage from Deux Ex Machina. (we were up to around Confidence Man then) And I remembered how awesome it was, and really wanted to see what was going on in that episode.

It's quite petty really.

I don't understand why they have such a problem with it.

Yeah I only started watching Lost because Dom was in it (big surprise there, huh?) but one day I was bored and searched Lost and somehow stumbled across LVI and watched a really great video.

Ever since then, Lost meant a whole lot more and I probably wouldn't have put in the same effort to buy the Season 1 DVD. I guess you could say that watching Lost videos made me....*gasp* obsessed.

Disney rarely knows what it's doing these days. But it makes me kind of worried that they'll go after my account, or much worse, go after LVI.

Meh, if it actually does come to that, we'll fight to the death.
