"If you ask Matthew Fox, she was the one to commit the party foul, not him.

The former Lost and Party of Five star is firing back with a countersuit against a female bus driver who sued Fox in September for allegedly socking her in her groin when she denied him entry onto a party bus outside a Cleveland bar.

So what's the latest in this ongoing legal drama? Depends on your vantage point.

According to Fox's complaint, a copy of which was obtained by TMZ, the driver, Heather Bormann, is lying about her allegations that the actor struck her during a physical altercation between the two on Aug. 27. Cleveland's Finest briefly detained the actor, but the incident did not result in criminal charges.

The suit by the 29-year-old mother of three claimed that a severely intoxicated Fox became angry when she refused his request to let him join a private bachelor party on a bus. According to court docs, when Fox persisted, she blocked his way, prompting him to attack her suddenly "without provocation," punching her in her privates as well as her right breast and arm and legs.

Bormann claims she hit back to defend herself, "cutting and bloodying his lip."

However, in his countersuit, the actor contends the driver actually provoked and assaulted him, not the other way around. As a result, Fox alleges he suffered "public hatred, contempt, ridicule and shame."

The suit asks for unspecified damages, claiming he lost out on a number of jobs due to negative publicity generated by the incident and Bormann's subsequent legal action.

Attorneys for Bormann could not be reached for comment while Fox's rep told E! News they had no statement on the matter."

Good for him. All she did was sully his name to every interviewer who would hear her story.

I had a strong feeling that she struck him first. And then to turn around lie and try to sue him?

about time he defended himself! Even if he manages to win, his name will still have been dragged through the mud. If he was guilty, and admitted it, fair enough, he would've deserved it, but there's always two sides to the story, so I'm glad he's finally decided to try and get his out there.

I agree. I never thought he did what she said he did. Only because in every interview she changed her story. If he was guilty and did it she wouldn't have had to do that.

I'm not at all surprised to find out that she hit him first.
